1. Controller and contact

The Diesel Emissions Justice Foundation (Stichting Diesel Emissions Justice, Chamber of Commerce no. 75260425), Herengracht 449A, 1017 BR Amsterdam, the Netherlands, values your privacy and is committed to protecting the personal data of our participants. The Foundation represents people harmed by the diesel-emissions scandal and acts as the data controller under the General Data Protection Regulation (GDPR).

2. Processing of personal data

Depending on your relationship with the Foundation, we may process the following categories of personal data:

We process this data to perform Participation Agreements for people claiming damages in respect of vehicles with fraudulently manipulated software manufactured by the Volkswagen AG group (including Audi, SEAT, Škoda and Porsche), Fiat Chrysler Automobiles (including Fiat, Jeep, Alfa Romeo and Maserati), Daimler AG (including Mercedes-Benz) and other responsible parties. We also process data to meet identity-verification obligations and to operate the website (device information, IP address and location data used for address autofill). If you subscribe to our newsletter we process your email address; every newsletter contains an unsubscribe link.

3. Retention

The Foundation does not retain personal data for longer than is necessary for the performance of the Participation Agreement and the conclusion of the legal proceedings and/or settlements. If you withdraw, the associated personal data is deleted. Anonymous, aggregated data (such as vehicle models and makes) may be retained for statistical purposes.

4. Recipients

We share personal data only where necessary. Recipients may include lawyers, counterparties, litigation funders, experts, courts and bailiffs. Any further sharing with third parties takes place only with your consent, to comply with a legal obligation, or on the basis of the Foundation’s legitimate interests.

5. Transfers to third countries

Where personal data is transferred outside the EU/EEA, this happens only where the European Commission has determined that the country offers an adequate level of protection, or where appropriate safeguards apply (such as standard contractual clauses approved by the Commission), in accordance with the GDPR.
